The terms that govern using this site and buying its services.
These terms govern your use of asharkawy.com and any services you book or buy through it — organizational engagements, Executive Consulting, and the practitioner program. By using the site or purchasing a service, you agree to them. Please read them alongside the Privacy Policy and Refund & Cancellation Policy.
Who you're dealing with
The site and its services are provided by Somatic Wellness Consulting FZC (“we”, “us”, “our”), a Free Zone Company registered with the Free Zones Authority – Ajman, Office C1-1F-SF5179, Ajman Free Zone, Ajman, United Arab Emirates. Your contract is with the company. Contact: info@asharkawy.com.
The services
- The practitioner program — an online course delivered in levels, with materials, sessions and cohort access as described on the program page at the time of purchase.
- Organizational engagements — consulting scoped and agreed separately in a written proposal or statement of work, which prevails over these terms where they conflict.
- Executive Consulting and consult calls — booked through the site and delivered remotely.
Descriptions, curriculum, dates and prices shown on the site may change before you purchase. What applies to you is what's shown at the moment you complete your order.
Bookings & payments
- All prices on this site are shown and charged in US dollars (USD). You're responsible for any taxes that apply in your own country unless stated otherwise, and your bank may apply its own conversion rate if your card is held in another currency.
- Payments are processed securely by Stripe. Your order is confirmed once payment is completed and you receive confirmation by email.
- Free or paid calls are scheduled through our booking system; please keep to the cancellation notice in the Refund & Cancellation Policy.
Access & your responsibilities
Program access is granted to you personally for your own professional development. You agree to provide accurate booking details, to keep any access credentials to yourself, and not to share, resell or publicly redistribute course materials.
Intellectual property
All course materials, frameworks (including the GAINS method), text, and designs on this site are our intellectual property or used with permission. You get a personal, non-transferable licence to use the materials you purchase for your own learning and professional practice. You may apply what you learn in your work; you may not copy, resell, or republish the materials themselves without written permission.
What the services are — and aren't
The program is skills-based professional learning, not certification, accreditation, professional licensing, or validation of professional competence. Its only course award is a non-accredited Certificate of Completion after the approved completion review. Any verification confirms issuance and record authenticity only. Neither the program nor its certificate guarantees employment, contracts, revenue, funding, client adoption, or any other business result; those depend on factors outside our control, including your context and effort. Nothing here is legal, financial, or HR advice for your specific situation.
Cancellation & refunds
Your cancellation and refund rights are set out in the Refund & Cancellation Policy, which forms part of these terms. Where you have statutory consumer rights (for example a right of withdrawal), those apply in addition and are not affected by this policy.
Liability
To the extent permitted by law, our total liability to you for any claim connected with a service is limited to the amount you paid for that service. We are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.
Third-party links
The site links to third-party tools and pages (Stripe, Tally, and the Somatic Experiencing practice, among others). We are not responsible for their content or practices; their own terms and privacy policies apply when you use them.
Governing law
These terms are governed by the laws of the United Arab Emirates as applicable in the Ajman Free Zone, and disputes are subject to the competent courts there, without affecting any mandatory consumer-protection rights you have where you live.
Changes
We may update these terms as the services evolve. The version that applies to a purchase is the one in effect when you make it. The “last updated” date above reflects the current version.
